Use of any of our software,  indicates your acceptance, your understanding and agreement to the terms, conditions, disclaimers, and policies stated below.

If you do not accept the terms, conditions, disclaimers, and policies stated below, please refrain from using this website, placing any order for any service or product and/or using any of our software.

This disclaimer and policies cover all past, present, and future purchases, website updates, and/or software updates.

LIMITATION OF LIABILITY:

Chaos Calibrations' ecu/dme tuning services, products and/or softwares are for off-road, competition, race-track use only.
Buyer/Customer/User assumes and takes full responsibility of all kinds and acknowledges that Chaos Calibrations has made him or her aware that these ECU/DME TUNING SERVICES, PRODUCTS, SOFTWARES and/or any advice given come without warranty and/or guarantees, stated and/or implied, and are intended for off-road, competition, race-track use, only. Chaos Calibrations' ECU/DME TUNING SERVICES, PRODUCTS AND/OR SOFTWARES may or may not be used in racing environments and you (Buyer/Customer) accepts all associated risks, even in the event when not used in off-road, Competition, race-track environments. You (Buyer/Customer) use all the information shared or advice given by Chaos Calibrations, services, and/or products at your own risk and responsibility.

The Buyer/Customer/User takes full responsibility of the use of Our ECU/DME TUNING SERVICES, PRODUCTS AND/OR SOFTWARES on their or any related vehicles which may or may not conform to all applicable laws and regulations for on road or highway use. It is your (Buyer/Customer/User) responsibility to comply with all applicable State, Federal, Province, Local laws.

IN NO EVENT SHALL CHAOS CALIBRATIONS OR ANY OF ITS AFFILIATES, AGENTS, EMPLOYEES, ASSIGNS OR THIRD PARTY CONTENT PROVIDERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE, OF OR INABILITY TO USE, ANY OF OUR  ECU/DME TUNING SERVICES, PRODUCTS AND/OR SOFTWARES, EVEN IF CHAOS CALIBRATIONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL CHAOS CALIBRATIONS OR ANY OF ITS AFFILIATES, AGENTS, EMPLOYEES, ASSIGNS OR THIRD PARTY CONTENT PROVIDERS BE LIABLE FOR ANY COMPUTER DAMAGE, VEHICLE DAMAGE, PERSONAL INJURY, DEATH, FINES, LAWSUITS, PROSECUTION, LOST PROFITS, LOST DATA, INCORRECT DATA, ENVIRONMENTAL DAMAGE, GOVERNMENT, LAW AND REGULATORY VIOLATIONS OR ANY OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM USE, OR INABILITY TO USE, ANY OF our ECU/DME TUNING SERVICES, PRODUCTS AND/OR SOFTWARES.

The Buyer/Customer/User absolves Chaos Calibrations from any and all responsibility, including but not limited to, any corrupt data, data loss, damages, injuries, and/or death and in ensuring that their vehicle is compliant with all State, Federal, Province, Local laws and emissions.

CHAOS CALIBRATIONS HEREBY DISCLAIMS ANY LIABILITY RESULTING FROM THE FAILURE TO USE THESE ECU/DME TUNING SERVICES, PRODUCTS AND/OR SOFTWARES IN COMPLIANCE WITH ALL APPLICABLE FEDERAL AND STATE LAWS AS WELL AS DAMAGES IN ANY AND ALL CAPACITIES.

ECU FILE LOCK:
Chaos Calibrations may or may not lock and/or encrypt our tune files. This aids in providing secure calibrations, use with our softwares, as well defending against 3rd party tampering. This does NOT prevent the ecu/dme from communicating for diagnostics, identification, datalogging or any other communication in any way.  The ecu/dme WILL remain fully functional at all times. This will have no affect on our customers as the ecu remains and otherwise functions the same.
If, for some reason, you find this to be against your best interest, please refrain from using our tuning services.

There is a small exception to this for MSV70/80 ECUs, you'll be notified in the Upload Instructions of the tuning process and how to revert back to factory when deep diagnostics is required, the ECU otherwise functions like normal and has no affect on day-to-day operations.

INTELLECTUAL PROPERTY:

This tuning service is considered intellectual property of Chaos Calibrations. The tune(s) can not be replicated or partially copied either for yourself, someone else or their vehicle, and/or maps/tunes.

TERMINATION AND REFUSAL OF SERVICE:

Chaos Calibrations remains the right to terminate and/or refuse any order or tuning service. Disrespect, profanity's, etc. toward any member of Chaos Calibrations is not tolerated at any capacity and may result in the refusal of service and/or the termination of your current order without refund.

RETURN & REFUND POLICY:
Tuning: Customers are eligible for a refund on tuning orders as long as a file or license has not been delivered. Full refunds are subject up to a 5% convenience fee. Once the first file and/or vehicle license has been delivered (tuning process started), there are absolutely no refunds, returns, exchanges, or cancellations.
Once an ECU/DME or product has shipped/been processed, there are no refunds, returns, or cancellations.

Adapters/Cables: Defective adapter/cables are eligible for exchanges. If any of our adapters or Chaos K+DCAN arrive with a defect or problem, please reach out to us for a solution. Adapters and cables are not available for returns or refunds, sales are final.

Merchandise/Apparel: Refunds are not accepted on stickers. Apparel may be eligible for a refund if a size exchange is not available. Shirt must be new, unworn, unwashed and undamaged. Must be the same condition as shipped; to be eligible for an exchange or a refund if an exchange is unavailable. If a shirt does not fit or feel as expected, you can exchange for a different size.

Shipping charges for returns/exchanges are at the expense of the customer, we can offer lower industry shipping prices to help.
In the event a refund is issued, any gratuities the customer added to an order and any processing fees will NOT be refunded.

Changes to Terms & Conditions/Disclaimers/Returns:

Although most changes are likely to be minor, Chaos Calibrations may change its Terms and Conditions/Declaimers/Return Policies from time to time, and at Chaos Calibrations’ sole discretion. Chaos Calibrations encourages visitors to frequently check this page for any changes to its Terms and Conditions/Declaimers/Return Policies. Your use of this website, our tuning services, products, and/or software after any change in this Terms and Conditions/Declaimers/Return Policies will constitute your acceptance of such change.
